1. TRADING INFORMATION
Waterless Composting Toilets NZ Limited (referred to as "the Seller", "we", "us", or "our") is the legal entity providing the goods and services under these Terms & Conditions. We operate under the trading name WCTNZ®.
Our registered place of business is located at 8A Woodruffe Avenue, Henderson, Auckland 0612, New Zealand.

Waterless Composting Toilets NZ Limited is a New Zealand owned business. Invoices and statements relating to purchases and shipping via our Shopping Cart will be issued to you by Waterless Composting Toilets NZ Limited at the email address you supplied during registration to our website. Invoices will be sent within 24 hours of order placement and will include the order number, item descriptions, quantities, prices, applicable taxes, shipping costs, and total amount due. The name that will appear on your invoices and statements will be Waterless Composting Toilets NZ Limited.
2. MINIMUM AGE AND LEGAL CAPACITY
- Purchasing products or services is restricted to individuals 18 years of age or older. Individuals below the age of 18 may have purchases made on their behalf by a parent or guardian.
- By proceeding with a purchase, you acknowledge that you have read, understood, and agreed to our Terms of Service, which are clearly displayed and accessible on our website prior to completing any transaction.
- Waterless Composting Toilets NZ Limited reserves the right to verify the age of any purchaser through appropriate means, which may include requesting a copy of a valid government-issued ID. By completing a purchase, the buyer confirms that they are 18 years of age or older, or that they are a parent or guardian making a purchase on behalf of a minor.
- Any attempt to circumvent the age requirement or provide false information regarding age may result in immediate cancellation of the order, refusal of service, and potential legal action. Waterless Composting Toilets NZ Limited reserves the right to report any suspected fraudulent activity to the appropriate authorities.
- Waterless Composting Toilets NZ Limited reserves the right to modify the minimum age requirement in accordance with changes in applicable legislation. Any such changes will be reflected in an updated version of these Terms & Conditions, which will be made available on our website. It is the responsibility of the buyer to review these terms periodically for any updates or changes.
- Should we suffer any loss or damage as a result of a transaction entered into by a minor, we reserve the right to seek compensation for such losses from the parents or guardians of the minor who caused the order to be placed.
3. ACCURACY OF PRODUCT DESCRIPTION
All products (goods) and services listed on this website are described to the best of our abilities and use the information available to us at the time. Care is taken to ensure that this information is correct, but we cannot eliminate the possibility of:
- Human error in the entry of information
- Incorrect information provided to us by suppliers or distributors
- Failure of suppliers or distributors to supply updated information to us
We reserve the right to change any information including but not limited to pricing, specifications, descriptions, or product names without notice.
4. PAYMENTS
- All orders are placed in New Zealand dollars.
- All orders must be paid in full before fulfilment.
- If an order is not paid within 2 weeks, it will be cancelled.
- We accept payments via credit card and bank transfer. Cash payments are not accepted for online orders.
- Our payment service provider is Windcave where the transitions are secured with Visa AIS and MasterCard SDP (PCI DSS) and sensitive information is encrypted with the 3DES protocol.
- In the case that you pay for an order with your credit card, we do not store your credit card number on our servers, however, it may be retained by our payment gateway provider in circumstances where this is required.
- In cases where your payment for an order fails for reasons including but not limited to insufficient card credit, or cheque dishonour, we do not warrant that stock will be held until an alternate payment method is available or the original payment method is made to function.
- In the case of offline payment, we will contact you to arrange payment. This process must be completed before your order can ship.
- In the event of any payment disputes, the customer should contact our customer service team within 14 days of the transaction. We will work to resolve the issue promptly. If a resolution cannot be reached, both parties agree to enter into mediation before pursuing any legal action.
5. TAX INVOICE AND CUSTOMER STATEMENTS
Upon completion of your order, we will supply a Tax Invoice to you in the form of an email. Please ensure that the email address you have provided us is correct.
6. PRICES AND TAXES
- Prices are Recommended Retail Pricing (RRP) excluding G.S.T (Tax).
- Prices may be adjusted periodically based on market conditions, supplier costs, or other factors.
- Quoted Prices are valid for 30 days from the date of quotation unless otherwise specified in writing.
- Taxes are G.S.T. Government (Goods & Services Tax) applied to prices at the rate of 15%
- Prices are displayed excluding G.S.T. if applicable to the product and in New Zealand Dollars.
- Additional Fees where applicable; shipping, handling, or other additional charges will be clearly displayed during the checkout process before the final purchase. These fees are not included in the displayed product prices.

If we determine that you are in a foreign country, we may display prices to you without GST and/or in alternate currencies.
7. SHIPPING AND FREIGHT
WCTNZ® affirms that all shipping and freight activities will be conducted in compliance with applicable local, national, and international shipping laws and regulations. We are committed to ensuring that all shipments meet the required legal standards and guidelines for safe and lawful transportation of goods.
- We use reputable shipping carriers such as Castle Parcels, NZ Couriers, Post Haste, and Mainfreight for all deliveries, and will select the most appropriate carrier based on the destination and shipping requirements.
- Our national delivery time frames range from one week to four weeks and depending on stock transitions additional time may apply.
- Notice of when your goods are dispatched will be provided to you at your registered email address. Tracking information will be included in the dispatch notification, allowing you to monitor your shipment's progress and the shipping method chosen.
- The buyer may select their preferred shipping method during the checkout process.

8. PICK UP ORDERS
- Notification and Dispatch: Once the goods are ready for pickup, WCTNZ will send a dispatch notice via email to the customer. This email will indicate that the goods are available for pickup.
- Pickup Location: Customers can collect their orders from designated warehouse locations. The specific pickup location will be communicated to the customer upon order confirmation.
- Hold Time: Once the goods are available for pickup, they are held for a period of two weeks. If the goods are not picked up within this time, the order may be subject to cancellation or other terms specified by the company.
9. UNCLAIMED GOODS
- In the event that goods remain unclaimed by the customer for a period of three (3) months from the date of dispatch, due to the customer's failure to pick up or receive the goods, WCTNZ® reserves the right to assume ownership of said goods. Concurrently, the associated order will be considered cancelled with no possible remuneration.
- Legal title of the goods transfers from WCTNZ® to the buyer upon successful delivery of the goods or when the buyer picks up the goods from the designated pickup location.

10. RETURNS & CANCELLATION POLICY
Note: All return requests are to be performed by the original purchaser with the original order number via the MY ACCOUNT menu by viewing the order and using the return request tab.
WCTNZ® will only accept goods returned with prior notification.
10.1. TERMS OF REFUND
10.1.1. Conditions
- Refunds are only applicable to products that have not been used (used is defined as soiled with human waste).
- Refunds are only applicable within 30 days of dispatch.
- Once used, products are eligible for Buy Back only OR for replacement parts if warranty applies.
If a product is purchased that satisfies one or more of the following cases, we will arrange a refund or replacement of the affected part:
Terms; “goods” & "products" are defined as the material property, not the shipping and/or handling charges or any other services associated with the goods.
10.1.2. Dispatched Goods
- The component is proven to be faulty within the warranty period.
- The product does not match its description as provided when sold.
- The product received is not the product ordered.
- Unused products may be returned upon request. However, the following items are non-returnable: custom-made products, perishable goods, and items that have been used or installed.
- The return is at the buyer’s risk and cost during the 30 days grace period (plus 5 days for delivery) for a total of 35 days from the shipment (dispatch).
- In the event that the product or component has been proven to have been damaged in transit, see Insurance Damages & Liability section above, Loss Or Damage, Clause II (3.2(II)).
10.1.2.1. Refundable Sums and Return Requirements
- The refund sum is from the GST-inclusive sum of the goods less a 25% restocking fee if the product is returned in the original condition and packaging. Refunds will be issued by bank transfer.
- If the product is in less than original condition Waterless Composting Toilets NZ reserves the right to recoup the cost of repairs & repacking from the refund sum up to 75% of the GST inclusive sum.
- All fees will be deducted from the sum of the refund.
10.1.2.2. Non-Dispatched Goods Caveats
- Goods that have not been dispatched will incur a 15% cancellation fee if cancelled. This covers transaction fees and administration costs.
- Cancellation requests must be submitted via email to sales@wctnz.co.nz or through the online cancellation form on our website. Phone cancellations are not accepted.
- Cancellation requests will be processed within 5 business days of receipt. The buyer will receive a confirmation email once the cancellation has been processed.
- The refund amount will be based on the original purchase.
- The minimum charge on all refunds will be 10 dollars admin fee plus the cost of transactional fees.
- All fees will be deducted from the sum of the refund.
- The seller will provide written confirmation of the cancellation to the buyer within 24 hours of processing the cancellation request.
10.1.2.3. Receipt of Goods by Buyer
- Products that are damaged in transit should not be signed for at the point of delivery as this will incur a change of ownership to the receiver and the delivery company & Waterless Composting Toilets NZ Ltd cannot accept liability of the condition of the goods after a signed receipt of goods “bill of lading” (BOL).
10.1.2.4. Return of Goods to Seller
- To initiate a return or exchange, customers must contact our customer service department within the 30-day period to obtain a Return Merchandise Authorization (RMA) number OR use your online account with your original order number and request a return at the Return Item(s) option (available within 30 days of dispatch only). Products returned without prior notice or without an RMA number will be rejected. If the customer ships goods without authorization the goods will be considered abandoned.
- Please ensure that returned products are safely packed in their original packaging. We will not be held liable for damage to products incurred during the return delivery.
- Buyer must send returned goods with signature required status and the following details “Attention; WCTNZ Return’s” followed by the order/invoice number.
- Return request approval requires the receipt of the goods and inspection.
- When a return request has been approved by Waterless Composting Toilets NZ the refund will be transferred on the 20th of the following month or 10 days after the approval date.
Refunds will be issued to the extent required by the Fair Trading Act 1986 (FTA) and Building Act 2004 (BA). No part of these terms of use is to be taken as an express or implied repudiation of our obligations under these pieces of legislation.
11. PRODUCT EXCHANGE
11.1. Paid Orders
- Before Dispatch - If an order is exchanged for another product that has not been dispatched, $50 administration fee applies.
- Post Dispatch - If an order is exchanged for another product that has been dispatched, a 15% re-stock fee applies and $50 administration fee applies. Can be done within 30 days of dispatch only.
11.2. Financed Orders
- Before Dispatch - If a financed order is exchanged for another product that has not been dispatched and restructuring of finance is required, $100 administration fee applies.
- Post Dispatch - If a financed order is exchanged for another product that has been dispatched and restructuring of finance is required, a 15% re-stock fee applies, and $100 administration fee applies. Can be done within 30 days of dispatch only.
12. WARRANTIES
Replacement Parts
- WCTNZ® is to furnish new parts to a customer whose toilet fails within the allotted warranty period for the particular component, provided that our inspection shows that such failure is due to defective material or workmanship.
- Any part supplied is warranted for the balance of the original warranty period based on the respective manufacturer’s warranty.
- All support information for warranty claims is to be supplied by the customer to WCTNZ® within 21 days of alerting WCTNZ® to the fault. This includes SO and SN numbers from the unit, WCTNZ® order number, a description of the fault, photographs of the fault, and any other relevant information WCTNZ® requests.
- The warranty period for a part begins from the date the original product was dispatched (plus 5 day additional days for transportation).
- All faulty parts are to be returned to WCTNZ®, shipping of these is the customer's responsibility.
- If a warranty replacement part is sent out and the original part is proven to not be faulty, the customer will be charged for the replacement part.
Replacement Parts Availability
WCTNZ® endeavours to hold replacement parts in stock to the best of our ability. If replacement parts are not available at the time of a warranty claim, the customer is responsible for covering all logistics costs from the point of origin.

13. PRODUCT BUYBACK
For your convenience, we can provide the service of returning your product to market as a Refurbished Composting Toilet with a Limited Warranty. BuyBacks are performed at 20-40% of the original purchase ticket value (depending on condition, at the discretion of WCTNZ®) and are limited to systems under 3 years old. To organize a Buy Back, contact WCTNZ® on 0800 022 027 or sales@wctnz.co.nz to make your Buy Back enquiry. Products shipped to WCTNZ® without prior notice will not be accepted.

14. SECURITY
We use industry-standard SSL encryption where applicable to protect the privacy of information in transit between this website, yourself, and our suppliers including payment gateways.
You acknowledge that the security of communications sent by electronic means cannot be guaranteed. You provide information to us via the Internet at your own risk. We cannot accept responsibility for misuse or loss of, or unauthorised access to, your personal information where the security of information is not wholly within our control.

15. JURISDICTION
These terms shall be construed in accordance with and governed by the laws of New Zealand. You consent to the exclusive jurisdiction of the courts in New Zealand to determine any matter or dispute which arises under these terms.
16. ACCESS AND ACCESSIBILITY
16.1. Accessibility

Waterless Composting Toilets NZ Limited warrants that the goods sold do not infringe upon any third party intellectual property rights, including patents, trademarks, copyrights, or trade secrets. In the event that any good is found to infringe upon a third party's intellectual property rights, we will, at our discretion, either:
- procure the right for you to continue using the good
- replace or modify the good so that it becomes non-infringing or
- accept the return of the goods and provide a full refund.
This warranty is contingent upon prompt written notice from you of any alleged infringement and your full cooperation in the defence of any claim.
23. RIGHTS
23.1. CUSTOMER RIGHTS
While the goods sold under this contract are not subject to the Consumers Guarantee Act (CGA), consumers retain certain rights under the Building Act 2004 and other applicable laws. These rights include:
- The right to goods that are fit for purpose and of acceptable quality
- The right to accurate information about the goods
- The right to fair and reasonable contract terms
- The right to seek remedies for faulty goods or services

23.2. DISPUTE RESOLUTION
In the event of any dispute arising from or in connection with this contract, the parties agree to the following dispute resolution process:
- The aggrieved party shall notify the other party in writing of the nature of the dispute
- Both parties shall attempt to resolve the dispute through good faith negotiations within 14 days of the notification
- If the dispute remains unresolved, the parties agree to participate in mediation with a mutually agreed-upon mediator
- If mediation is unsuccessful, either party may then pursue legal action through the appropriate courts
This dispute resolution process does not limit any party's right to seek urgent injunctive or declaratory relief where appropriate.
24. TERMS OF SERVICE
Both customers and staff of WCTNZ® are expected to conduct themselves in a respectful, professional, and honest manner at all times. Any form of abuse, harassment, or discrimination will not be tolerated.
